These Terms of Use (“Terms”) govern access to websites, applications, beta features, and services provided by Eluca Beauty LLC (“Eluca,” “we,” “us,” or “our”). By accessing or using a Service that links to these Terms, you agree to them and to our Privacy Policy.
1. Eligibility and accounts
You must be legally able to agree to these Terms. If you are under the age of legal majority where you live, you may use the Services only with permission from a parent or legal guardian. Certain beta features may be limited to users 18 or older. You are responsible for accurate account information, protecting your credentials, and activity through your account.
2. What Eluca provides
Eluca helps users organize beauty products, build routines, record preferences and history, explore recommendations, and—where enabled—share selected activity with friends. Features may change, be limited, or be discontinued, particularly during a private or public beta.
3. Recommendations are informational
Recommendations, AI outputs, community patterns, reviews, ingredient information, and routine suggestions are provided for general informational purposes. They are not medical diagnosis or treatment and do not replace advice from a dermatologist, physician, pharmacist, or other qualified professional. Patch test products, follow manufacturer instructions, and seek professional help for allergies, irritation, prescriptions, or health concerns.
4. Product, retailer, and affiliate information
Product details, availability, ingredients, shades, prices, and retailer information may change or contain errors. Confirm important information with the brand or retailer before use or purchase. Eluca may receive compensation when you follow certain links or make qualifying purchases. Material relationships will be disclosed clearly near relevant recommendations or links. Unless expressly stated, brands and retailers do not sponsor, endorse, or partner with Eluca.
5. Your content and sharing
You retain ownership of content you submit. You grant Eluca a non-exclusive, worldwide, royalty-free license to host, store, reproduce, format, display, and use that content only as reasonably necessary to operate, improve, and provide the Services according to your settings and our Privacy Policy. You represent that you have the rights needed to submit the content.
You are responsible for the audience you select when sharing. Do not post unlawful, misleading, infringing, harassing, dangerous, or private information about another person without permission. Eluca may remove content or restrict sharing to protect users or the Services.
6. Acceptable use
You may not misuse the Services; attempt unauthorized access; scrape or extract data except as expressly permitted; interfere with security; upload malware; impersonate another person; manipulate reviews or community signals; use the Services for unlawful discrimination; reverse engineer protected portions of the Services except where law permits; or use Eluca content or outputs to train competing models without written permission.
7. Eluca intellectual property
The Services, including Eluca’s name, branding, software, interface, editorial content, and original materials, are owned by Eluca or its licensors and protected by law. These Terms provide a limited, personal, revocable, non-transferable right to use the Services; they do not transfer ownership. Third-party product names and trademarks belong to their respective owners.
8. Beta services
Beta features may be incomplete, contain errors, change without notice, lose test data, or be unavailable. Do not rely on a beta as the sole record of important information. Feedback you provide may be used by Eluca without restriction or compensation, provided we do not publicly identify you without permission.
9. Suspension and termination
You may stop using the Services at any time and may request account deletion as described in the Privacy Policy. Eluca may suspend or terminate access when reasonably necessary to enforce these Terms, protect users or security, comply with law, or discontinue a Service. Provisions that by their nature should survive will remain effective.
10. Disclaimers
To the fullest extent permitted by law, the Services are provided “as is” and “as available.” Eluca disclaims implied warranties, including merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that recommendations will work for you, that information will be error-free, or that the Services will always be secure or available. Some jurisdictions do not allow certain disclaimers, so portions may not apply to you.
11. Limitation of liability
To the fullest extent permitted by law, Eluca and its officers, employees, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or loss of data, profits, goodwill, or opportunity arising from the Services. Any aggregate liability will be limited to the greater of amounts you paid Eluca for the Services during the preceding twelve months or US $100. These limitations do not apply where prohibited by law.
12. Governing law and disputes
These Terms are governed by California law, without regard to conflict-of-law principles. Unless applicable law requires otherwise, disputes will be brought in state or federal courts located in Los Angeles County, California. Nothing in these Terms limits rights that cannot legally be waived. Any arbitration or class-action waiver, if adopted, will be added only after legal review and appropriate notice.
